1. Acceptance of Terms

By accessing or using RealScan ("the Service"), you agree to be bound by these Terms of Service, our Privacy Policy, and our Refund & Cancellation Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Service Description

RealScan is an AI-powered property intelligence platform that provides:

• Property Analysis Reports: Comprehensive PDF reports analyzing Indian properties using live MahaRERA data
• Trust Score: 0-100 AI-generated risk assessment based on 21+ data points
• RERA Verification: Live data on project registration, construction status, complaints, and legal issues
• Builder Track Record: Historical performance analysis of real estate developers
• Financial Projections: Investment returns, ROI estimates, and market positioning insights
• PDF Reports: Downloadable, shareable reports for personal or professional use

The Service is currently available for MahaRERA-registered properties in Maharashtra, India. We are expanding to other states in India in the future.

3. Disclaimer of Investment Advice

RealScan is a decision-support tool, not a substitute for professional due diligence. You are solely responsible for your investment decisions.

4. Data Sources & Accuracy

RealScan sources data from the following publicly available sources:

• MahaRERA: Maharashtra Real Estate Regulatory Authority public database
• Google Maps API: Location, coordinates, nearby amenities
• AI Analysis: GPT-4o for pattern detection and narrative generation
• Market Data: Supplementary public real estate data sources

Data Limitations: While we strive for accuracy, we do not guarantee the completeness, reliability, accuracy, or timeliness of any data. RERA data is sourced from government portals and may contain errors, omissions, or delays inherent to those systems. Property data may become outdated between the time of analysis and your viewing. Always verify critical information directly with MahaRERA, the developer, and through independent verification.

5. User Accounts & Eligibility

Account Creation: To use RealScan, you must create an account by providing accurate and complete information, including a valid email address and password.

Age Requirement: You must be at least 18 years old to use RealScan.

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials (username and password). You must notify us immediately of any unauthorized access or security breach. You may not share your account, sell access, or allow others to use the Service with your credentials.

6. Subscription Plans, Payments & Refunds

RealScan offers the following subscription plans:

• Free Plan: Limited analysis credits per month
• Investor Plan: 25 analyses/month (paid subscription)
• Pro Plan: 100 analyses/month (paid subscription)
• Broker Plan: Unlimited analyses (paid subscription)

Billing: Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely through Razorpay (India) or Stripe (International). By subscribing, you authorize us to charge your payment method until you cancel.

Cancellation: You may cancel your subscription at any time from your account settings. Your access will continue until the end of the current billing period. No pro-rated refunds are provided for mid-cycle cancellations.

Refunds: For complete refund eligibility and conditions, please refer to our Refund & Cancellation Policy. As RealScan provides digital products delivered instantly, refunds are only granted under specific circumstances outlined in that policy.

7. Acceptable Use Policy

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Scrape, crawl, or systematically extract data from RealScan without authorization
• Use the Service for any unlawful, fraudulent, or malicious purpose
• Resell, redistribute, or commercially exploit RealScan reports without prior written permission
• Interfere with the Service's infrastructure, servers, networks, or other users' access
• Upload malicious code, viruses, or engage in any activity that compromises security
• Impersonate others or create fake accounts
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate your account if you violate this Acceptable Use Policy.

8. Intellectual Property Rights

Ownership: All content, features, functionality, and technology underlying RealScan — including the RealScan Trust Score algorithm, AI models, software code, design, reports, and branding — are the exclusive intellectual property of Probasal Tchnologies and are protected by Indian and international copyright, trademark, patent, and intellectual property laws.

Report Usage: Reports generated for your account are for your personal or internal business use. You may share individual reports with clients, colleagues, or third parties using the built-in sharing feature. However, you may not:

• Remove or alter RealScan branding, watermarks, or disclaimers from reports
• Republish, resell, or mass-distribute reports for commercial gain without authorization
• Claim reports as your own work or misrepresent their authorship

9. Limitation of Liability

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Probasal Tchnologies, RealScan, and our officers, directors, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Investment decisions you make based on RealScan reports

11. Termination

Your Right to Terminate: You may terminate your account at any time by contacting customer support or using the account deletion feature in your settings.

Our Right to Terminate: We reserve the right to suspend or terminate your account and access to the Service immediately, without prior notice, if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent or illegal activity
• Fail to pay subscription fees
• Abuse or harass our team or other users

Upon termination, your right to access the Service ceases immediately. Downloaded reports remain yours, but you may not access the platform or request new reports.

12. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or Service features. Significant changes will be communicated via email or in-app notifications. The "Effective Date" at the top will indicate when the Terms were last updated. Continued use of RealScan after changes constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may request account deletion.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through:

1. Informal Resolution: Contact us first at support@realscan.in to attempt good-faith resolution
2. Arbitration: If informal resolution fails, disputes shall be resolved through binding arbitration in Mumbai, India, under the Indian Arbitration and Conciliation Act, 1996
3. Court Jurisdiction: For claims not subject to arbitration, the courts of Mumbai, Maharashtra, India shall have exclusive jurisdiction

14. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and RealScan.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full effect.

No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
